The book "Philosophical Foundations of Neuroscience" is an engaging criticism of cognitive neuroscience from the perspective of a Wittgensteinian philosophy of ordinary language. The authors' main claim is that assertions like "the brain sees" and "the left hemisphere thinks" are integral to cognitive neuroscience but that they are meaningless because they commit the mereological fallacy—ascribing to parts of humans, properties that make sense to predicate only of whole humans. The authors claim that this fallacy is at the heart of Cartesian (...) dualism, implying that current cognitive neuroscientists are Cartesian dualists. Against this claim, we argue that the fallacy cannot be committed within Cartesian dualism either, for this doctrine does not allow for an intelligible way of asserting that a soul is part of a human being. Also, the authors' Aristotelian essentialistic outlook is at odds with their Wittgensteinian stance, and we were unconvinced by their case against explanatory reductionism. Finally, although their Wittgensteinian stance is congenial with radical behaviorism, their separation between philosophy and science seems less so because it is based on a view of philosophy as a priori. The authors' emphasis on the a priori, however, does not necessarily commit them to rationalism if it is restricted to conceptual or analytical truths. (shrink)

Elliott Sober''s selection for/selection of distinction has been widely used to clarify the idea that some properties of organisms are side-effects of selection processes. It has also been used, however, to choose between different descriptions of an evolutionary product when assigning biological functions to that product. We suggest that there is a characteristic error in these uses of the distinction. Complementary descriptions of function are misrepresented as mutually excluding one another. Background Making the right decisions, while simultaneously showing respect for patient autonomy, represents a great challenge to nursing home staff in the issues of life-prolonging treatment, hydration, nutrition and hospitalisation to dying patents in end-of-life. Objectives To study how physicians and nurses protect nursing home patients' autonomy in end-of-life decisions, and how they justify their practice. Design A qualitative descriptive design with analysis of the content of transcribed in-depth interviews with physicians and nurses. Participants Nine physicians and ten nurses in (...) 10 nursing homes in Norway. Results and interpretations Assessment of the patient's competence to consent to treatment is almost absent. The physicians build their practice on the principles of beneficence and nonmaleficence. Nurses tend to trust the patients' rejection of life support, even when the patients have difficulty speaking or suffer from dementia. Relatives were, according to the health personnel, included in decision-making processes to a very limited extent. However, futile life support is sometimes provided contrary to the physicians' judgement of what constitutes the patient's best interest on occasions when they are pressurised by next of kin. Conclusions The study reveals a need to improve decision-making routines according to ethical ideals and legislation. Conflicts between relatives and healthcare professionals in the decision-making process deflect the focus from searching for the best possible treatment for the terminal patient. Further discussion is required as to whether the concept of autonomy is applicable in situations in which the patient is impaired and dying. (shrink)

Human societies are extraordinarily cooperative compared to those of most other animals. In the vast majority of species, individuals live solitary lives, meeting to only to mate and, sometimes, raise their young. In social species, cooperation is limited to relatives and (maybe) small groups of reciprocators. After a brief period of maternal support, individuals acquire virtually all of the food that they eat. There is little division of labor, no trade, and no large scale conflict. Communication is limited to a (...) small repertoire of self-verifying signals. No one cares for the sick, or feeds the hungry or disabled. The strong take from the weak without fear of sanctions by third parties. Amend Hobbes to account for nepotism, and his picture of the state of nature is not so far off for most other animals. In contrast, people in even the simplest human societies regularly cooperate with many unrelated individuals. Human language allows low-cost honest communication of virtually unlimited complexity. The sick are cared for, and sharing leads to substantial flows of food from the middle aged to the young and old. Division of labor and trade are prominent features of every historically known human society, and archaeology indicates that they have a long history. Violent conflict among sizable groups is common. In every human society, social life is regulated by commonly held moral systems that specify the rights and duties of individuals enforced, albeit imperfectly, by third party sanctions. (shrink)

Human migration is nonrandom. In small scale societies of the past, and in the modern world, people tend to move to wealthier, safer, and more just societies from poorer, more violent, less just societies. If immigrants are assimilated, such nonrandom migration can increase the occurrence of culturally transmitted beliefs, values, and institutions that cause societies to be attractive to immigrants. Here we describe and analyze a simple model of this process. This model suggests that long run outcomes depend on the (...) relative strength of migration and local adaptation. When local adaption is strong enough to preserve cultural variation among groups, cultural variants that make societies attractive always predominate, but never drive alternative variants to extinction. When migration predominates, outcomes depend both on the relative attractiveness of alternative variants and on the initial sizes of societies that provide and receive immigrants. (shrink)

This study examined the quality of children's assent to a clinical trial. In subjects younger than 9 years of age, understanding of most aspects of the study was found to be poor to non-existent. Understanding of procedures was poor in almost all subjects. In addition, voluntariness may have been compromised in many subjects by their belief that failure to complete the study would displease others. If the fact that a child's assent has been obtained is used to justify the exposure (...) of that child to the potential harm of a non-therapeutic blood sample, the assent must be meaningful. In the nutrition study observed here, the quality of the assent of children younger than 9 years of age was very poor. The assent therefore did not provide a valid justification for requesting a blood sample from these children. This study indicates that most children younger than 9 years of age cannot be expected to consent or assent to clinical research in a meaningful way. The current age of 7 years for initiating assent (in addition to parental consent) is possibly not appropriate and should be reconsidered. (shrink)

Following promulgation of the Nuremberg code in 1947, the ethics of research on human subjects has been a challenging and often contentious topic of debate. Escalation in the use of research participants in low-income countries over recent decades , has intensified the debate on the ethics of international research and led to increasing attention both to exploitation of vulnerable subjects and to considerations of how the 10:90 gap in health and medical research could be narrowed. In 2000, prompted by the (...) discussions over several years that led to the US NIH launching a capacity building programme on research ethics for members of research ethics committees in developing countries, we advanced a ‘new look’ for the ethics of international research.1 Since then progress has been made on several fronts.First, our ideas—considered somewhat radical and impractical at the time—have been provocatively addressed by scholars who have either contested them or advanced similar conceptions of what obligations international researchers have to research participants and communities in low income countries before, during and after clinical trials. Second, those researchers who have been sympathetic to our ideas have either endeavoured to put these into practice or have investigated the feasibility of doing so. Third, the intractability of the 10/90 gap and the escalation of interest in global health have sensitised many to the need to amplify the uptake of these ideas in practice.Here, we briefly review the conceptual and practical developments in international research ethics. Background: Theoretically, the principle of justice is strong in healthcare priorities both nationally and internationally. Research, however, has indicated that questions can be raised as to how this principle is dealt with in clinical intensive care. Objective: The objective of this article is to examine how significant others may affect the principle of justice in the medical treatment and nursing care of intensive care patients. Method: Field observations and in-depth interviews with physicians and nurses in intensive care units (ICU). Emphasis (...) was placed on eliciting the underlying rationale for prioritisations in clinical intensive care with particular focus on clinicians’ considerations when limiting ICU treatment. Results: Significant others could induce an unintentional discrimination of ICU patients. Family members who were demanding received more time and attention for both the patient and themselves. Patients’ and families’ status and position and/or an interesting medical diagnosis seemed to govern the clinicians’ priorities of patients and families—consciously as well as unconsciously. The clinicians emphasised that patient information given through families was important. However, patients’ preferences and values conveyed to clinicians through their families were not always taken seriously. This even applied in cases with very serious prognoses and an explicit patient wish to forego life-prolonging treatment. Conclusion: The principle of justice was violated when qualified attention was given to significant others, and through this also to patients. Attention given to significant others was influenced by the healthcare workers’ professional and personal values, attitudes and interests. (shrink)

It is argued that the preservation of truth by an inference relation is of little interest when premiss sets are contradictory. The notion of a level of coherence is introduced and the utility of modal logics in the semantic representation of sets of higher coherence levels is noted. It is shown that this representative role cannot be transferred to first order logic via frame theory since the modal formulae expressing coherence level restrictions are not first order definable. Finally, an inference (...) relation, calledyielding, is introduced which is intermediate between the coherence preservingforcing relation introduced elsewhere by the authors and the coherence destroying, inference relation of classical logic. Axiomatic set theory is the concern of this book. More particularly, the authors prove results about the coding of models M, of Zermelo-Fraenkel set theory together with the Generalized Continuum Hypothesis by using a class 'forcing' construction. By this method they extend M to another model L[a] with the same properties. L[a] is Gödels universe of 'constructible' sets L, together with a set of integers a which code all the cardinality and cofinality structure of M. Some applications are also considered. (...) When someone sees one of us busily scribbling formulas or structures, he or she has no trouble identifying a chemist. The author of this rather lengthy book proposes another way of obtaining a glance at the "heretofore rarely seen unity of the Kantian system." He suggests a common theme present in and often foundational for, many of Kant’s reflections, the notion of "action" ; more generally the notion of the human subject itself as a kind of Handlung. Such a project is certainly a plausible one. Kant’s frequent use of notions like spontaneity, self-legislation, freedom, and others make the prospects for (...) the author’s ambitious attempt at least relatively reasonable. Often, though, instead of a unified interpretation of various texts, we find here just isolated interpretations of Kantian issues, some indeed intimately connected with the theme of action, many tangentially related, a few not at all. The author’s whole approach also causes some difficulties. His style can most charitably be described as idiosyncratic; neologisms and odd contructions abound in every section: "transcendental constellation," "transcendental motion," "world projection," "practical being," "practical apperception," and so on. References to philosophers whose doctrines could, by contrast or similarity, help clarify Kant’s, are almost nonexistent. There is little reference to Leibniz, only a few references to Schelling and Hegel, and no discussion of Fichte’s theory of Tathandlung. Indeed there is no reference to any recent or classic secondary Kant literature. There is also a curious, brief, sweeping dismissal of all "analytic" philosophies of action as all committed to a thoroughly "causal" interpretation of action as observable behavior, predicable of a subject. Background: A fair distribution of healthcare services for older patients is an important challenge, but qualitative research exploring clinicians’ consideration in daily clinical prioritisation in healthcare services for the aged is scarce.Objectives: To explore what kind of criteria, values, and other relevant considerations are important in clinical prioritisations in healthcare services for older patients.Design: A semi-structured interview-guide was used to interview 45 clinicians working with older patients. The interviews were analysed qualitatively using hermeneutical content analysis and template organising style.Participants: 20 (...) physicians and 25 nurses working in public hospitals and nursing homes in different parts of Norway.Results and interpretations: Important dilemmas relate to under-provision of community care and comprehensive approaches, and over-utilisation of certain specialised services. Overt ageism is generally not reported, but the healthcare services for the aged seem to be inadequate due to more subtle processes, for example, dominating considerations and ideals and operating conditions that do not pay sufficient attention to older patients’ needs and considerations of justice. Clinical prioritisations are described as being dominated by adapting traditional biomedical approaches to the operating conditions. Many of the clinicians indicate that there is a potential for improving end of life decisions and for reducing exaggerated use of life-prolonging treatment and hospitalisations.Conclusion: The interviews in this study indicate that considerations of justice and patients’ perspectives should be given more attention to strike a balance between specialised medical approaches and more general and comprehensive approaches in healthcare services for older patients. Professor Plant has presented a briefer treatment of Hegel’s philosophical development than did H. S. Harris in Towards the Sunlight, and a considerably more historical, epistemological and metaphysical treatment than is presented in Pelcynski’s Hegel; Political Philosophy and not so exhaustive an account of the political and social philosophy as appears in Avineri’s Hegel’s Philosophy of the Modern State. These four books taken together testify to the importance of Hegel on the contemporary philosophic scene. Plant’s volume is perhaps the best (...) in that it pulls together the various philosophical, political, and social strains in brief compass, for he demonstrates quite convincingly, as did Avineri and Harris, that the political and metaphysical writings of Hegel are closely interconnected and that the interpretation of art and religion flow from his considered interpretation of his contemporary cultural situation. Plant, with Marx, Engels, Kierkegaard, Baur, Feuerbach et al. and against Findlay and Bergman, argues that there is a Christian theological residue in Hegel’s system, but surprisingly, the fruit of the system is clarification not mystification. Only with that residue is the system and totality really explicable. An altogether welcome book.—R.L.P. (shrink)

Professor MacIntyre has here collected twenty-three of his essays. They range in topics from discussions of psychoanalysis to the relation between reasons and causes in accounts of human action. Indeed, the very range of such issues is part of the point of the book itself. In part 1 of the book, MacIntyre has collected some of the articles he has written over the last fifteen years or so for Encounter, New York Review of Books, and Partisan Review; in part 2, (...) the more traditionally philosophic pieces which first appeared in Philosophy, Philosophical Review, and Journal of Philosophy; by collecting both sets of essays within one set of covers, he has tried to make a point about the relation between such apparently different intellectual contexts. Most broadly, that point has to do with the common problem of "ideology" as it is found in each arena, whether as some explicit, historically achieved "self-image" by means of which individuals struggle "to provide the light that our individual and social lives need", or as the problem of the general role beliefs, reasons, desires, and the like should be said to play in human action, in what way such factors are related to causal explanations of action, and how decisions about such questions affect any view of what a social science is. MacIntyre believes that these somewhat more practical and more theoretical contexts need to be thought together, first because reflection on current, dominant ideologies greatly needs the benefit of "detailed, analytical conceptual inquiries," and because that analysis itself has often paid insufficient attention to its own broader, historical, even ideological context, and the effect such a context can have on methodology. Thus, while it is of the utmost importance to analyze thoroughly and as clearly as possible the language of morals, the methodology of that analysis alone cannot help in determining whether such a language is indeed the language only within which moral discourse can take place, and might also fail to appreciate historical alterations in the meaning of important terms. A careful, detailed, summary and interpretation of the development of Kant’s views on political philosophy from his early denial that the concept of obligation could be derived from Wolff’s Naturkausalität until all the major elements of his own Rechtsphilosophie could be identified. The major source for the author’s reconstruction of these largely unpublished views is, of necessity, the large volume of disorganized, problematically dated Reflexionen, and student transcripts and summaries of his lectures. He convincingly organizes these materials into four main (...) "phases": 1762-1765, when legal obligation was grounded in the notion of the "analogon rationis"; 1766-68, "The competent judge as necessary condition of law"; 1769-1771, with its initial attempt to connect a universal order of law and the problems of "Verstandes erkenntniss"; and post-1772, wherein, the author asserts, the truly critical foundation for Kant’s philosophy of law is discovered, his transcendentally justified notion of freedom. All of this material represents a judicious and quite useful compilation of pertinent Reflexionen and marginalia, but the author’s main purpose in amassing and presenting this often confusing material is interpretive and polemical.
